For permitted areas, you’ll need to obtain a Miami-Dade County Certificate of Use (renewed annually), a Florida Department of Business and Professional Regulation Vacation Rental License, and a Local Business Tax Receipt. Miami Beach also requires setting up a Resort Tax account and including your license numbers on every advertisement or listing. Occupancy limits in Miami-Dade are two guests per bedroom plus two additional guests (maximum of 12, excluding children under three). Noncompliance can result in steep fines, so ensuring proper licensing and zoning is essential before operating a vacation rental.

However, if you accept direct bookings or use a platform that does not remit all applicable taxes, you are responsible for collecting and submitting:
- Florida’s 6% state sales tax plus any applicable county surtax (floridarevenue.com).
- Miami-Dade County transient rental taxes (Tourist Development Tax, Convention Development Tax, etc. - miamidade.gov).
- Miami Beach Resort Tax (4%) for rentals under six months and one day (miamibeachfl.gov).
